LEGAL RESPONSIBILITIES


National legislation requires all drivers to notify the Driver Licensing Authority in their state of "any permanent or long-term injury or illness that affects his or her safe driving ability" (Assessing Fitness to Drive, 2003, page 10). This law exists in all Australian states and territories except Western Australia. The law imposes penalties for failure to report. Additionally, drivers may be liable under common law for continuing to drive knowing that they have a condition that could affect their ability to drive.

Injuries or illnesses that could affect safe driving are outlined in the national medical guidelines "Assessing Fitness to Drive for Commercial and Private Vehicle Drivers".
